These Terms of Use (“Terms”) govern access to and use of the QueueRX website, platform, mobile applications, and temperature monitoring hardware (together, the “Services”) provided by PhaBO Labs LLC (“PhaBO Labs,” “we,” “us”). By using the Services, you agree to these Terms.
The Services are intended for pharmacies and pharmacy professionals. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it current.
Paid plans are billed monthly or annually per the pricing in effect at purchase. The temperature monitoring device is a one-time hardware purchase with a one-year warranty including free replacement; revalidation is required every three years for a fee. Fees are non-refundable except as required by law. We may change pricing with reasonable advance notice effective at your next billing cycle.
QueueRX is an operations and compliance support tool. It does not provide medical, legal, or regulatory advice, and it does not replace the professional judgment of a licensed pharmacist or your obligations under applicable law. You remain solely responsible for dispensing decisions, regulatory compliance, and responses to recalls and alerts.
You retain all rights to the data you submit to the Services. You grant us a limited license to process that data to provide and improve the Services, consistent with our Privacy Policy and any business associate agreement in place. You are responsible for having the rights and consents necessary to submit the data.
You agree not to misuse the Services, including attempting unauthorized access, interfering with operation, reverse engineering, reselling without authorization, or using the Services in violation of applicable law.
The Services, including software, design, and documentation, are owned by PhaBO Labs and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription.
The Services are provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, PhaBO Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, and our aggregate liability will not exceed the amounts you paid for the Services in the twelve months preceding the claim.
You may cancel at any time effective at the end of the current billing period. We may suspend or terminate access for breach of these Terms. Upon termination, your right to use the Services ends, and we will make your data available for export for a reasonable period.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. We may update these Terms; continued use after changes take effect constitutes acceptance.
